Terms and Conditions


TERMS AND CONDITIONS OF SALES AND PURCHASE AGREEMENT

> > 1 This invoice (contract of acquisition) is issued in response to your > intent to purchase the items invoiced above. As such it is taken to be a > legally binding contract that obliges both parties to pay in full for the > goods (You "the buyer"), and honor the delivery of the goods (Guy Hepner aka > "the seller"), within the agreed terms of payment. You accept the contract > is formed and the obligation for both parties to complete the transaction, > is upon the time of invoicing, not upon the time of delivery of the items > detailed within the invoice. Items are delivered upon receipt of payment, > not before. This does not negate your obligation to settle the outstanding > balance of the invoice until the point of delivery. Art is a tradeable > commodity which experiences constant price fluctuations. The invoicing and > delivery policy is enforced in order to prevent speculative purchasing and > renaiging based on changing market values after the time of invoicing. Terms > of payment are taken by default as immediate unless another arrangement > exists and are detailed in writing on this invoice. > > 2. We (the seller) may ask for a credit card number at the time of > invoicing, even if you request to pay via other means, in order to hold the > items listed on the invoice for you until payment of the invoice by you. > Your card will not be charged other than in the event of you failing to pay > the invoice within the criteria set out in point (1) of these terms of sale. > Where terms are stipulated as immediate, your card will not be charged for > settlement of any outstanding balance sooner than 30 days from the date of > issuance of the invoice, and only in the event that you fail to settle the > balance of the invoice via other means. Do not provide your card details to > us unless you accept this stipulation. > > 3. All goods are guaranteed authentic for life. If they are deemed not > authentic by either a major auction house (Sotheby's, Christie's or Phillips > de Pury), or the studio/estate of the artist, you are entitled to a refund > in full. Proof of authenticity or otherwise must be provided in writing from > at least one of the sources previously listed. If a refund is sought more > than 30 days after the date of delivery, allow 90 days for the return of > funds to you. > > 4. Goods are not refundable on any grounds other than authenticity. Goods > may be exchanged at the discretion of the seller, but Guy Hepner does not > offer either a "cooling off" period, nor the right to return items within > any period of time. Art is a tradeable commodity which experiences constant > price fluctuations. The non return policy is enforced in order to prevent > speculative purchasing and returning based on changing market values. > > 5. Condition reports on pieces are available on request. All pieces have > full condition reports online. The buyer is expected to have read and > understood this condition report prior to purchase. If the buyer has any > queries regarding condition, a further written condition report will be > supplied upon request, and can be detailed within this invoice if requested > by you. There may be small handling creases, particularly at the corners of > pieces when they are more than 10 years old (pre 1999). > > 6. Packing and shipping is the responsibility of the buyer, Guy Hepner > is not a professional packing and shipping company. Every care it taken to > ensure that goods are not damaged during shipping and as such goods will > only be shipped internationally via Fedex, UPS or DHL. Liability cannot be > taken by the seller for damage caused during shipping/third party handling. > DHL shipments will be fully insured, UPS and Fedex have a limited liability > insurance policy. Guy Hepner can refer you to a professional packer and > shipper should you have any concerns relating to items being damaged during > packing or shipping. All expenses relating to packing and shipping are the > responsibility of the buyer. > > 7. Partial payment does not dictate partial delivery of goods. Credit > facilities may be agreed in advance and will be issued on a case by case > scenario. Should credit facilities be agreed, they will be detailed within > the invoice. Should the invoice be only partially settled, the goods will be > held securely on behalf of the buyer until the invoice is settled in full. > Guy Hepner does not operate a partial payment, partial fullfillment of items > policy. Partial settlement of an invoice does not entitle the buyer to "pro > rata" delivery of items up to the value of payment received, should it be > less than the total amount of the invoice for multiple items. 8. Delivery times vary depending on the items in question. For custom orders, allow up to 90 days for delivery. If framing is requested, allow an additional 30 days. Most order are fulfilled within 30 days.
9. Items are by default supplied without framing. Framing is available on request, please contact us if you would like your item delivered framed. Framing costs are the responsibility of the buyer. If an item is invoiced inclusive of framing, the will be detailed below the item title on the invoice.
> > > 10. Title of ownership does not pass to the buyer until cleared funds have > been received in full.
11. Upon issuance of this invoice, please notify us within 24 hours should be unhappy to comply with any of these conditions if invoiced via email. After 24 hours from the point of invoice via email, it is accepted that you have read, understood and accepted these terms and conditions of sale. If invoiced in person, terms and conditions are accepted at the time of meeting. Payment of this invoice indicates that you have read, understood and accepted these terms and conditions of sale.
